The Town Commission will consider filing a lawsuit at its Monday, Dec. 6, regular commission meeting in an effort to obtain code compliance from one of its residents. In a letter dated Nov. 24, 2010, Town Attorney David Persson informed resident James Armstrong of the town’s intent to pursue litigation as a means to obtain Armstrong’s compliance in his ongoing code enforcement issue. Longboat Key resident James Armstrong believes the town is in violation of a state statute. He claims he was hit with a charge of pass-through payroll expenses as part of administrative costs for his property construction project that, according to town Code Enforcement, was performed in violation of town code. The town of Longboat Key has subsequently placed a lien against Armstrong’s property, in the 2900 block of Gulf of Mexico Drive, because he has not yet paid the administrative fee of $2,178.50.

So OK, let’s go to court. Let’s fight the battle of the Key Club all over again. Why not? It can only cost us time, money and angst. Which one of those three will be most expensive? Take your choice. My vote for the worst is the loss of time.

The Longboat Key Property Owners’ Coalition filed a complaint Friday, July 30, asking the Circuit Court to find the Town of Longboat Key’s approval of the Key Club redevelopment plan in violation with land use regulations and specifically the town’s Comprehensive Plan.
