Power lines spark trees
4:30 p.m. – Officer Coffman – 600 block, St. Judes Drive North – I responded to the location on St. Judes in reference to power lines arching in the trees to the rear of the address. Upon arrival I observed the power lines sparking. Longboat Key Fire Department responded and stood by until Florida Power & Light could arrive to fix the problem.
Piña coladas and pot
10:40 p.m. – Officer Mislyan – 5300 block, Gulf of Mexico Drive – While on patrol, I observed a black four-door Jeep bearing tag 134MXK driving below the posted speed limit and weaving in its lane. Other traffic was passing this slow-moving vehicle. I clocked it on moving traffic radar at 34 mph and 38 mph in a posted 45 mph zone. The vehicle also was over the solid white line to the right and on the yellow centerlines to the left of the traffic lane. The vehicle at one point sped up to 51 mph.
I conducted a traffic stop in the 5300 block, and the driver appeared to be under the influence of drugs and/or alcohol. He admitted to drinking a piña colada and to smoking marijuana. His breath still smelled of freshly burnt cannabis. He agreed to perform the Horizontal Gaze Nystagmus Field Sobriety Task and did so poorly. He gave verbal consent to officers to search his vehicle for marijuana, but refused to sign a consent form. The vehicle was searched with negative results. Only residue was observed on the floorboard carpet. Subject stated that he was smoking marijuana at home. He appeared to be more impaired on the cannabis than alcohol. He stated that he had only one drink.
Driver agreed to sign a release of liability for his vehicle to be parked at the police station overnight and was driven home to Bradenton Beach by Officer Thomas. The couple stated they were having a boyfriend/girlfriend argument in the vehicle prior to being stopped by the police.

No parking zone
3:54 p.m. – Officer Brey – 600 block, Lyons Lane – After completing a call in the area, I was flagged down by the complainant regarding the parking of construction trucks and workers’ cars on the north side of the street, designated as a ‘no parking zone.’ The complainant said it is a continuing problem. At that part of the roadway, parking is restricted on both sides of the street, leaving no place for these vehicles to be parked where they would not be in violation. Upon conversation with persons on the job site, they agreed to move vehicles over as far as they could as not to impede traffic/emergency vehicles and would park as many on the job site as they could. The complainant seemed satisfied with this.
Missing garbage can
4:08 p.m. – Officer Brey – 500 block, Harbor Point Road – The complainant came into the Police Department to report they had received a bill for $60 from Waste Management Company for a garbage receptacle of which the complainant never had possession. It was reportedly delivered to their rental property in August 2008, but the complainant never saw it. They have since sold the home and now reside in Sarasota. Waste Management indicated they would waive the $60 charge if they reported the property as missing to the police.

Exhausted kayaker
2:20 a.m. – Officer Silverio Jr. – 100 block, Gulf of Mexico Drive – While on water patrol of Longboat Pass, a kayaker flagged me down. The kayaker stated that he was exhausted from a voyage from New Pass. The kayaker asked if I could get some help. I loaded the vessel operator and his kayak on board my patrol vessel and transported him to Overlook Park. The operator was dropped off near his vehicle. No further action.
June 26
Late night smoker
12:51 a.m. – Officer Thomas – 500 block, Ketch Lane – I was on patrol when I observed a person standing in the shadows at the corner of Ketch Lane and Gulf of Mexico Drive. As I turned my marked police car around to observe the subject, he began walking southbound. I stopped and exited my patrol car and asked the subject if he would mind speaking with me. The subject walked toward me and agreed to speak with me. After further questioning during the consensual encounter, the subject said he resided with his family and that he was waiting alongside the road for his younger brother to be returned home. The subject further advised that a man that his family was staying with had taken his 15-year-old brother with him and had not returned yet. He also stated that they left the home around 10:30 p.m. I advised the subject that I would follow him home and confirm his story with his mother.
I went to the residence at the 500 block of Ketch Lane and met with his mother. She confirmed that they did not know that the suspect had taken her 15-year-old son. The family was unsuccessful at calling the suspect on his cell phone due to not having enough minutes. The female subject gave me the suspect’s phone number, which I was attempting to call when he pulled into the driveway.
I met with the suspect as he exited his car. I explained the police presence and the concerns that the family had shared with us regarding his having their 15-year-old family member since 10:30 p.m. He stated he thought they knew he had the boy. I asked him if he knew what time it was. He did not. He was informed that it was now 1:20 a.m. He was surprised at the time. As I was talking to him I noted that his pants pockets were bulged. I advised him I would like to pat him down for my protection and asked him to place his hands on his car’s trunk. He complied and I patted him down. I felt several objects in his pockets including what had the shape thru feel of a smoking pipe.
I stepped away from the suspect and he turned toward me. I asked if he had any illegal drugs or paraphernalia on him. I asked that if he did if he would not mind removing it from his pockets and placing it on his trunk. He complied and removed several items from his pockets to include a wallet, watch, pocketknife, prescription pills, lighter and a brown smoking pipe. I picked up the pipe off the trunk. It had the strong smell of freshly burnt marijuana on it. I read the suspect his Miranda rights from a waiver of rights card. He answered that he understood his rights and agreed to talk further with police. I asked him for what he used the pipe. He stated he used the pipe to smoke marijuana. He was asked if he had any marijuana, and he stated he didn’t have any left. He then offered to allow officers to search his vehicle. A search of the vehicle was conducted with negative results except for residuals found on the carpet and inside the door pocket. I advised him that I would be issuing him a notice to appear for his possession of paraphernalia. I completed the notice to appear and issued a copy to the subject. He read and understood the notice to appear.
Business DL cancelled
8:59 p.m. – Officer Thomas – 3000 block, Gulf of Mexico Drive – I was on patrol when I observed the black pick-up truck southbound in the 3000 block of Gulf of Mexico Drive. It was nighttime conditions, and the truck had its headlights on but did not have its taillights functioning. I conducted a traffic stop using the marked patrol car’s overhead red and blue lights. Upon stopping the vehicle, I greeted the driver and explained my reason for stopping him. The driver was asked for and provided his driver’s license and vehicle information. The driver told me he had a business-purposes-only license. A computer check revealed that the subject’s driver’s license was suspended as of June 14, 2010, due to non-compliance with court-ordered counseling and that he did not have a business-purpose-only permit. Upon speaking with the subject, he advised that he knew he needed to get the counseling but did not know his business permit had been cancelled. He was still in his work uniform and was coming from the direction of his employment. I issued him a written warning for the inoperative taillights and a UTC for the driving while license suspended without knowledge. He signed a release from liability waiver, electing to leave his vehicle temporarily parked alongside the roadway in the 3000 block of GMD. His driver’s license was seized to be placed in the department’s confiscated driver’s license locker.
Craig’s list caper
9:36 p.m. – Officer Martin Jr. – 5000 block, Gulf of Mexico Drive – The complainant came to the police department to report suspected Internet fraud. She advised that she had attempted to purchase a Vespa Scooter on Craig’s list. All was going well, and then the seller wanted her to switch to EBay and pay using Western Union. She had contacted EBay, and they told her that it was fraud because they don’t use Western Union and only use Pay Pal as a secure way to pay for goods and services. The complainant was smart enough to catch it before she paid out any money. The complainant gave me copies of the e-mails that had been exchanged, and I placed them in file. I explained to her the difficulties in locating the suspect even using the e-mail address that he had signed up under. She stated that she would try to get further information from him, like a valid phone number. I told her if she was successful to pass the information on to us. Nothing further at this time.
Homesick and stranded
10:56 p.m. – Officer Thompson – 4000 block, Gulf of Mexico Drive – While on patrol, I observed a verbal dispute between the two subjects. They advised that the female subject wanted to leave the unit she was sharing with the male subject and his children. He advised her that he could not take her home and leave his children. She agreed to go to the hotel lobby and wait for a ride from her family. He went back to his room, and no further action was taken or required.

2:13 p.m. – Officer Misylan – 500 block, Ketch Lane – I responded to a disturbance in progress and complainant states that a 16-year-old subject was threatening to fight with him. Upon arrival I spoke with the complainant who stated that he took rent money ($600) from the listed subjects and that they were to stay in the house for one month. Now he is having a dispute with their 16-year-old son. He wants them to leave now. I spoke with one of the subjects, the mother of the 16-year-old juvenile, and she states that she has nowhere else to go and is paid until July 3. She has three other children with her ages 10, 13 and 15. I spoke with the other subject who states that he will have money June 28 and will move the family out at the same time. Complainant and the others involved agreed to stay in the house together. Subjects stated that they are longtime friends and agreed to get along for the next week. No physical altercation occurred.

Loud-mannered gents
9:54 p.m. – Officer Martin Jr. – Sea Place, 2000 block, Gulf of Mexico Drive – We responded to the address regarding some type of noise disturbance. We arrived and made contact with the occupants and inquired if everything was OK. The male adult subject was very rude and argumentative. He stated we were invading his privacy. We advised him that we were there checking on the welfare of the persons staying there. We cleared the residence after verifying everyone was OK. The subjects staying there are foreigners and didn’t quite understand how things are done here. There was a similar call last year for the same thing. Apparently they like to talk loud, which worried the neighbor. No violation observed. Nothing further.

The complainant states that he is not injured and does not know the subjects or what motivated them to strike him. He heard the subjects yell from the vehicle as it went by. The vehicle then continued north on GMD. The complainant stated that he is not sure if he can identify the subject. He also stated that he is willing to prosecute for battery if found.

I conducted a traffic stop and found that the driver did not have a motorcycle endorsement. He said he had lost his sunglasses earlier. He was issued a warning for the eye protection and a criminal summons for violation of driver’s license restrictions: no motorcycle endorsement.
Weaving down GMD
7:31 p.m. – Officer Misylan – 1000 block Longboat Key Club Road – I observed a white Chevy van in the beach access at the 3200 block. The vehicle started up and pulled out when the patrol entered the lot. The white male driver, later identified as the registered owner, did not have his seatbelt on. A registration check showed that the vehicle owner’s driver’s license was suspended for failure to pay a traffic fine.
The vehicle headed southbound and was speeding, then tailgating a silver SUV with a handicapped license plate. The silver SUV pulled into the center lane to let the white van pass. The van then sped up again and was clocked on moving traffic radar at 54 mph in a posted 35 mph construction zone. The vehicle was weaving back and forth and over the white line. The vehicle quickly turned right into Longboat Key Club Road north and the gate was in the open position. I activated my emergency lights and the vehicle kept traveling around the bend and then left into a driveway next to a private residence. The two front-seat occupants, male and female, began to move around in the vehicle and reach under and between the seats. The driver was contacted, and it was confirmed that the driver was the registered owner.
He said he paid the ticket and did not know his license was suspended. He was very nervous. He was seen smoking and blowing smoke out of the window when stopped. He was asked for consent to search the vehicle for weapons and drugs. He refused to allow us to search. He was issued citations and released. Passenger held a valid license and was allowed to drive the van.

I then spoke with the complainant, the subject’s daughter, who was concerned for her father, as this relationship seemed very abusive in nature. He advised that there was no physical contact between him and his girlfriend. I did note a small abrasion to his forehead, which he advised was due to an earlier injury. Both subjects agreed to remain separate for the remainder of the night and discuss the issues in the morning.

3:29 p.m. – Officer Quarmby – 4700 block, Gulf of Mexico Drive – I woman had checked out of the Hilton Hotel and continued to remain on the beach, this is commonly allowed by the management as long as the room is vacated by the agreed time. She had her dog with her and left it in the vehicle with the vehicle running and air conditioning on at 65 degrees. Patrons made several complaints to the hotel desk when they saw the dog in the car, and therefore management called police. Management asked that she be asked to leave the premises since she was causing guests alarm and refusing to not leave the dog unattended. I contacted the woman and advised her of the complaints and the request for her to leave. I further advised her that in the current high temperatures (90 degrees), it would take only several minutes for her dog to die from the heat if the car stalled while she was on the beach. She complied with reservation.
Dine and dash
8:13 p.m. – Officer Bourque – On the listed date and time I was dispatched to Mar Vista Restaurant for the report of two people leaving and not paying their bill. The caller said the suspects fled in a red 2005 Chevy truck, tag number unknown. They were last seen turning north onto Gulf of Mexico Drive. I was responding from south of that location. I had dispatch give out a BOLO (Be On the Look Out) to Bradenton Beach. She also notified Manatee Sheriff’s Office. While responding I did not see the suspect vehicle. Once on scene, I spoke to the restaurant manager. I took the information for this report. I canvassed the area but was not able to locate the suspects. I gave the manager my business card with the report number.
My interview with the manager of the restaurant: Tonight at about 7 p.m., two people came into the restaurant for dinner. After eating they were given a bill for $37.84. A few minutes later the two left. They left $29.00 on the table, which did not cover the bill. As the two suspects drove off, the manager ran out to Broadway to see if he could see where they went. He saw them turn north on Gulf of Mexico Drive. He told me he had never seen them before. He does not want to prosecute unless they refuse to pay. He said the male suspect was about 5 feet 8 inches and 280 pounds, with shoulder length white hair, a white beard, blue shirt, tan shorts, about 50 to 60 years old. Upon receiving this complaint I advised dispatch and proceeded to check the woods and beach. I passed a couple, who were dressed and carrying their chairs and umbrella, leaving the beach. At this point I did not have information that a female had accompanied the nude subject. Upon walking further on the beach toward Beer Can Island, I was contacted by one of the complainants who stated that the couple I had seen was in fact the subjects of the complaint.
I detained the couple and contacted one of the witnesses who drove by in an attempt to identify the subject she saw. It should be noted that the couple now had covered bathing suits with shorts and shirts; the man had removed his hat. The complainant stated that she was not positive if they were the same subjects. Subjects were warned about laws regarding public nudity and also advised that any additional incidents could result in arrest. They were then released after wanted checks returned negative.
A few minutes later another witness arrived and stated that he was positive that the couple was the same people he had seen earlier. He further stated the male had been in the water to his chest. He saw two of the complainants walking along the beach and purposely waited until they were within visual range and then walked out of the water naked in front of them. At this point this report serves as documentation that the violator was contacted and warned of the law and the possibility of being arrested if he continues this behavior.

The tracks appear to be less than six feet apart and appear to have been made by a smaller type vehicle/auto. They appear to have been made sometime within the last few hours. Report written for information and documentation only.

Vehicle was stopped and driver initially refused to produce his driver’s license. He was argumentative throughout the stop. A male and female guest had been out by the pool drinking alcoholic beverages when the female started to use loud profanity. The two were asked to leave the property, as they do not stay at Cedars. As they were leaving, they continued to be loud and disruptive. Another employee walked out to observe the two and called 9-1-1, as they appeared not to be leaving, but the phone was too distant from its base station to work properly and it disconnected. The man and the woman left the property on foot. He told me he would call the police should the two return. I advised I would check the area for the subjects.
As I was checking the area, I observed a male walking back onto the Cedars property. I confirmed with him that he had been one of the subjects involved in the earlier disturbance. She declined to give the man’s name, preferring to think about how she wants to proceed with this incident. As she leaned back away from him, she lost her balance and fell backwards, landing on the floor. She declined being injured. She was asked what kind of shoes she was wearing and she showed me that she had been wearing high heels when this incident happened. She then demonstrated to me how the incident occurred, leaning backwards away as if the unnamed male were kissing her goodbye, then falling backwards on the floor. I asked her how many drinks she had tonight. She said she had about six drinks this evening. She appeared intoxicated to me. I began checking the location with assisting Officer Thomas. While inspecting the posted construction site, we detained subject #1 who walked out from underneath the home. Shortly after, a second male was found hiding under a stairwell. He was naked from the waist down and his t-shirt was inside out and backwards. Both subjects were arrested for trespassing on a posted construction site. Post Miranda warning, both subjects admitted being in the home and knew they were not supposed to be there. Where’s my stuff
8:49 a.m. – Officer Coffman – 500 block, Schooner Lane – I responded to the location in reference to a burglary alarm. Upon arrival I noticed a large U-Haul truck backed up into the driveway. I was met by subject who told me that his sister, who owns the residence, asked him to go to the house and remove her personal belongings for her. He told me she is going through a divorce. She had given him a key to the house but when he arrived he found that the locks had been changed. He told me he was able to remove a sliding glass door on the pool deck and then was able to unlock the front door so his helpers could remove the personal belongings. He set off the alarm when he opened the doors. He told me that he thought the divorce had been finalized and was only doing what his sister had asked of him. I asked him to stop what he was doing until I could talk with both the homeowners.
I talked with his sister first. She stated that she was still married and that she had signed the deed over to her husband on the home but wanted her personal belongings out. I told her that she was not on the property and her brother did not have any legal paperwork with him stating what he could take and that it would be better if he returned everything back inside the house until the divorce is settled and a judge determines who can have what. She agreed.
I talked with the husband next and informed him of what had happened. He said that no one had his authorization to be in the house or remove any belongings. He did say that there was a Hide-Away storage container in the driveway that had some of his wife’s belongings in it and that she could pick those items up. He said he wanted everything else put back inside the residence and the house secured. I told him I would standby to make certain that happened. Once everything was back inside I called the husband and told him such. I had no further involvement.
