Cannabis catch
7:16 p.m. – Officer Mislyan – 500 block, Broadway – A juvenile defendant was observed smoking what appeared to be marijuana on the beach with two other White males. He was also observed closing a small zip lock baggie and placing it into his pocket. The subjects walked back to Broadway Street. I met with him, and he smelled of freshly burnt cannabis. He was asked to empty his pockets, and the baggie of loose cannabis was discovered. He admitted to smoking marijuana with his friends. He was transported to LBKPD and his guardians were notified. He was transferred to Manatee County Juvenile Assessment Center.

In and out beer run
4:25 p.m. – Officer Erickson – 525 Bay Isles Parkway – Subject was observed walking into Publix. He walked straight to the beer cooler, took a 12-pack of Natural Ice Beer, valued at $7.47, put it into his backpack and walked directly out of Publix without paying for it. The Publix manager, who stopped the suspect and called LBKPD, observed this. The suspect’s backpack was placed into property and the suspect was arrested.

Shot heard across canal

He was then advised of the Town ordinance that prohibits the discharging of firearms on Longboat Key. He advised that he understood and would comply. He was checked for wants/warrants and prior violations (negative) and released.

Brawler escapes death
6:46 p.m. – Officer Thomas – 100 block, North Shore Road/Greer Island – I responded to the area in reference to a reported drowning victim and assault. I arrived after the LBKPD Fire Department was already on scene. I was able to gain access to Greer Island by way of a ladder that the Fire Department had rigged from the bridge to the island.

Upon descending the ladder to the island, I made my way, approximately 200 feet, toward the Fire Department personnel who were treating a White male injured person who was later identified as a Bradenton resident. The victim appeared to have difficulty breathing and had several abrasions on his left side forehead along with a cut above his left eye. I asked several people milling about as the victim was being treated if they had seen what happened. All spoken with were in various stages of intoxication. All advised that there had been a fight but that they hadn’t witnessed it. I then spoke with a White female. It was quickly apparent that she was not intoxicated and I asked her if she knew what had happened to the victim. She answered that she had witnessed the event and she then went on to relate the following:

She observed the victim involved in an argument with a White male that she only knew by first name. She could not elaborate any further about him. She did not know what the argument was about but it got physical and she observed the victim swing a punch at the other man. The two then began exchanging punches. The witness then noticed a White female she’d been observing earlier and believed to be the girlfriend of the man she only knew by first name. The girlfriend got in between both men. It appeared that the victim inadvertently punched the girlfriend during the exchange of punches between both men. After this, both men continued punching each other and the fight traveled into the water. Other beach goers got involved to break up the two men. As everyone exited the water, the witness noticed that the victim was floating and not getting out of the water. Another beachgoer entered the water to get the victim out and the unknown White female unsuccessfully tried to intervene. The victim was brought out of the water where they saw he was having trouble breathing so 911 was called.

I advised the witness that I would like her to complete a written statement. She agreed to do so and I asked her to follow me toward the bridge where I would get paperwork for her to fill out. As we began walking toward the bridge, we were stopped by an unknown White male who wanted to know where I was taking the witness. I explained she was giving a witness statement. He insisted that she didn’t need to speak with police. She advised the male that it was OK and she was going to give a statement. The male again persisted that she didn’t have to speak with the police. My observations of the male were that he was somewhat intoxicated, so I patiently explained to him that this was a police investigation and his actions were impeding my investigation. He again attempted to persuade her the witness from her desire to speak with me, at which time I advised him that if he continued to obstruct my investigation I would place him under arrest. She confirmed with him that she was OK to talk with me regarding this incident. The unknown male’s loud protests toward my wanting to obtain a statement from her had caused a large group of beachgoers to surround us. I led her through the crowd toward the bridge where she stood by with Officer Thompson while I climbed to the bridge to obtain a written statement form. She completed the sworn statement during which time the Fire Department personnel removed the victim by way of a borrowed boat to a dock where they transported him by ambulance to Blake Hospital.

I responded to Blake Hospital to interview the victim. My observations of his physical condition were as follows: abrasions and lumps to the left side upper area of his forehead, just above his left eye. There was a small cut just above his left eye. He had an injured left hand, which was swollen to about the size of a baseball in the area of the webbing between his thumb and forefinger. It was already turned a black/blue/purplish color. He was having some trouble breathing but seemed to be able to do so without his oxygen mask. He had various other scratches and abrasions and commented during the course of the interview that his back was bothering him.

I introduced myself and then asked him what happened. He said he had gotten into a fight. I asked what happened to start this. He stated that words were tossed around between us, words went back and forth and she hit me. He continued by stating that she hit him and then the guy hit him. The victim was asked who the male and female were and he denied knowing them or their names. I asked him if he hit them back, and he denied doing so. I asked him how much had he had to drink today, and he stated 10 beers and maybe some liquor before this happened. I asked him how he got to “Beer Can Island,” and he said by boat. I asked him what happened to his injured hand. He answered that he hit it. I asked again what happened. He responded that his thumb bent backwards when he hit it. It was horseplay and he didn’t recall what he hit it against. I asked if he hit the other guy who hit him. He said that he didn’t remember “the fight” but that he may have hit him and that he had been drinking too much. He was asked how long he’d been on “Beer Can Island” today and he answered since about noon. He added that he remembers getting in a “tussle” but that’s about it.

He and I then discussed some of his past history involving excessive drinking and his getting into what he described as “a lot of fights.” He told me that he has tried to calm down and not get into fights as much. I explained to him that I believe I was able to find an independent witness who observed the incident. I explained to him that based upon the witness’ statements and his statements, I believed the fight was a mutually involved incident. He told me that it sounded like I was right. He asked I call his girlfriend and gave me the phone number. I made the call as he requested and left a message. A short time later, the girlfriend returned my call and I explained to her about his predicament. She advised she might come by to see him. I gave him this news along with one of my LBKPD business cards, asking him to call us if he had any further information regarding his case. He thanked the police department for being so kind to him.

Before departing the hospital, I was advised that he was considered to be in stable condition but he may be admitted due to some water in his lungs. As of the time of this writing, I have not been able to identify whom the White female and the White male who were involved in the fight with the victim. No further action at this time.

Tree trimmer goes too far
8:49 a.m. – Officer Morningstar – 500 block, Ranger Lane – I responded to the location for a disturbance. I met with the complainant, who advised that his neighbor/suspect was causing trouble by trimming one of his trees past his side of the property line. I attempted to calm the situation by explaining to the suspects that they were not allowed to trim past the property line; suspects stated it wasn’t that big of a deal and they really did nothing wrong. Complainant, at the time, stated he wished to make a formal complaint. The suspects stated it was accidental that the tree was trimmed back too far, and that she was responsible because she had hired (suspect) to do the work and had told him where to cut. The tree trimmer was advised that if he is going to continue in this line of work he needs to restrict his activity to the property in which he is paid to work. The tree trimmer advised he is not licensed for this business. I observed one branch that appeared to have been cut at the property line, a couple small branches have been cut or broken within approximately one foot of the property line and another three or four have been cut or broken within approximately six inches of the property line. Patrol Action: Capias forwarded to the State Attorney.

I advised her of a couple alternate locations. The suspect left the area without incident.

It didn’t work out
10 a.m. – Officer Quarmby – Complainant requested an officer stand by at her residence on Sloop Lane while she retrieved her purse and car. She and her boyfriend had been involved in a dispute the night before. It was established that the complainant does reside at the residence; she has clothing, furniture, and a cat and receives mail there. According to complainant she and her boyfriend had been in his vehicle in Sarasota the night before. During the argument her boyfriend told her to get out of the car, and after a brief struggle he left her there. The complainant stayed with a friend who drove her to the residence to meet with police.

The complainant was unable to get into the front door with the key as it was bolted from the inside. It was evident that her boyfriend was inside but refusing to open the door. The complainant was able to enter the house via the bedroom door at the pool. Once inside she opened the door for Captain Cummings and I. Her boyfriend was advised that she was there to retrieve her purse and car. He stated that he had thrown all of the stuff into the bay. He appeared to be intoxicated and was angry with the complainant. While the complainant was on the upper level getting clothing he began to walk in her direction and was asked to remain in the living room. He hesitated then bolted up the stairs, grabbed her purse and tried to throw it over the bedroom balcony into either the bay or the pool. The landlord was advised to proceed with the legal eviction process; he stated he would. The 2002 green VW FL tag# 061XMV quickly exited the lot. I then conducted an investigative stop in the 6000 block of GMD for fear of crimes against person or property had been committed.

I then made contact with the driver, a White female Sarasota resident. She was wearing a shirt and not wearing pants. I asked for her Drivers License and registration and told her to get dressed. She had a skirt on but had it up around her waist. She complied and pulled it down to cover herself. Her stated reason for being in the plaza was she checked on her boyfriend in the Village and stopped by here briefly. I asked if she had any narcotics on her and for consent to search. She gave consent voluntarily, and gave up a glass one-hitter pipe with marijuana residue. I asked if there was more and she gave me a second glass (bowl style) pipe with marijuana residue. An interior search of her vehicle revealed no further contraband.

I confiscated the two pipes, which were turned into property with evidence tag#0959 to be destroyed. No criminal charge filed due to trace residue only being found. She was reminded that the businesses in that area are closed and she was trespassing.

Work not up to snuff
11:33 a.m. – Officer Silverio- 7100 block, La Lenaire Drive –This officer spoke on the phone with the owner of a home on La Lenaire Drive on Jewfish Key. She advised that the contractor that she fired this day left the job site with construction items that belong to her. The items taken were boxes of stone flooring, 50 to 60 spruce 2 x 4’s, and several rolls of felt paper for the roof. She stated that the contractor had just left this site and was located at the south Coquina Boat Ramp. I went to the boat ramp by patrol vessel and located the contractor in his workboat. He was identified by a previous contact. I spoke to the contractor about the items removed. He stated that the items that he took were used as tools for his company. I had him explain this to me. The large amount of 2 x 4’s was for cribbage for the sheets of plywood on the job site. The 14 rolls of roof felt paper were discarded by the homeowner and he installed peel and stick roof paper for the new roof. The peel and stick paper replace the cheaper felt paper. The small peel and stick roll on board his boat was given to me to return to the complainant. The stone flooring was from another job that he worked at.

He brought those to the complainant to see if she liked the flooring for her home. I counted over 10 boxes. I then asked if he had a copy of the contract. He did give a copy, just not here. I thanked him for his cooperation and went to Jewfish Key. I met with the complainant and returned the roll of the peel and stick paper. The complainant was upset with the contractor for several different matters concerning the work done to the home and land area. I asked the complainant if she had a copy of the contract, receipts and itemized purchases. She stated that she only has a contract that had vague information on it about what was to be done to the home. She did state that she has numerous emails that talk about specific things to be done. The contractor was already given about $40,000.00 to do the roof and tree removal.

I advised that without specific information about the contract, this was only a civil matter between her and the contractor. She did state that she would be pursuing this in a court of law. She did show me some of the work performed on the home. She stated that the work performed by the contractor was not done as specified. This report was written for legal purposes.

Beware of phone scam
9:56 p.m. – Officer Bourque – 2000 block, Harbourside Drive – I responded in reference to a suspicious phone call. Once I arrived the complainant told me earlier this date at about 8 p.m. he got a phone call from a person who identified himself as Deputy Robert Johnson with the Sarasota Sheriff’s Office. This person told the complainant that an unknown person had stolen the complainant’s social security number and credit card numbers. The caller/deputy said he needed to get the complainants social security number and credit card numbers so he could protect them. The complainant asked for the deputy’s phone number. The caller/deputy said he was not at a phone right then, but gave him a phone number, which comes back to the Public Defenders Office. The complainant told the caller the name of one of his credit cards, but would not release any further information. The caller told the complainant the credit card company would be contacting him.

A few seconds after he hung up a female who identified herself as Tammy Harris (an employee of the credit card company) called and tried to get the card number, and social security number from the complainant. The complainant gave her the last eight digits of the card but nothing else. The complainant said the female was very persistent. The complainant had to hang up the phone on her to get her to stop insisting on the information.

The complainant then called the Sarasota Sheriffs Office and spoke to Deputy Caldwell who told him several people in Sarasota had called tonight to complain about the same type of calls. The Deputy said it was not them (SSP) calling. The Deputy told the complainant to call the Longboat Key Police Department and report the incident. I checked and found no number was left on the caller ID. I called and spoke to Deputy Caldwell who told me they had about 10 such reports tonight. They have no leads in their cases either. I told the complainant to monitor activity on his credit card, and if any fraudulent charges appear to contact us right away. He also signed up for a fraud alert program just prior to my arrival.

Too many fish
11:02 a.m. – Officer Silverio – Off the Key – While on water patrol of Sarasota Bay, bay sector 3, in the Longboat Key Club Moorings, I saw the subject in his vessel coming from the north perimeter canal. I waved to him and asked him to come over to me. I asked if he had any catch onboard. Inside the vessel were two large white coolers and a couple of cast nets. The operator stated that he had a bunch of mullet onboard. I asked how many. He stated about 60 or 70. I advised dispatch that I was stopping this vessel for a fisheries violation.
